Welcome to Patina Archive. These Terms of Service (“Terms”) govern your use of patinaarchive.com and any purchases made through Patina Archive, including purchases made through our website, social media channels, messaging platforms, or other authorized sales channels.

By visiting our website, creating an account, placing an order, or purchasing from Patina Archive, you agree to these Terms.

1. ABOUT PATINA ARCHIVE

Patina Archive specializes in vintage, pre-owned, collectible, and secondhand clothing, accessories, and related goods.

Many of the items we sell have been previously worn, stored, washed, repaired, altered, or otherwise used before reaching Patina Archive. Signs of age and wear are part of the nature and character of vintage clothing.

Our products may include items that are rare, discontinued, collectible, or one-of-one.

2. VINTAGE AND PRE-OWNED CONDITION

Unless specifically stated otherwise, products sold by Patina Archive should be considered pre-owned and sold in their existing condition.

Vintage and used items may show characteristics including:

Fading
Discoloration
Cracking or wear to graphics
Loose threads
Small stains or marks
Fabric wear
Pilling
Repairs
Alterations
Missing or worn labels
Distressing
Shrinkage
Minor holes or imperfections
Signs of previous washing, storage, or use

We make reasonable efforts to identify and photograph significant flaws, but vintage garments may contain minor imperfections that are not specifically noted.

Normal age-related wear consistent with a vintage or pre-owned garment is not considered a product defect.

Product photographs form part of the product description, and customers should review all available photographs before purchasing.

3. PRODUCT DESCRIPTIONS

We make reasonable efforts to provide accurate product descriptions, measurements, colors, photographs, brands, approximate eras, materials, and condition information.

However, we do not guarantee that all information will be completely free from errors.

Information regarding the age, era, model, manufacturing date, or historical origin of a vintage product may sometimes be based on labels, construction details, graphics, reference materials, or our reasonable assessment.

Where an exact manufacturing date cannot be confirmed, dates or eras should be considered estimates.

4. SIZING AND MEASUREMENTS

Vintage sizing can differ significantly from modern sizing.

A garment labeled “Large,” for example, may fit differently from a modern Large due to changes in sizing standards, previous washing, shrinkage, alterations, or manufacturing differences.

For this reason, customers should rely primarily on the actual garment measurements provided in the listing, rather than the size printed on the garment's original tag.

Customers are responsible for comparing listed measurements with a garment they already own or otherwise determining whether an item will fit before purchasing.

Differences in fit resulting from vintage sizing are not considered product defects.

5. COLOR AND PHOTOGRAPHY

We make reasonable efforts to display product colors accurately.

However, colors may appear differently depending on lighting, photography, screen settings, device displays, and the condition of the item.

Minor differences between the color shown on a screen and the physical item are not considered defects.

6. AUTHENTICITY AND BRAND REFERENCES

Patina Archive sells vintage and pre-owned merchandise from many brands and manufacturers.

Unless expressly stated otherwise, Patina Archive is an independent reseller and is not affiliated with, sponsored by, endorsed by, or an authorized dealer of the brands whose products may appear on our website.

Brand names, logos, trademarks, team names, artist names, event names, and other identifying information may be used solely to accurately describe and identify the products being offered.

We make reasonable efforts to evaluate items before listing them. Any authenticity statement reflects our assessment based on available information unless the product is accompanied by third-party authentication specifically identified in the listing.

7. ONE-OF-ONE INVENTORY

Many Patina Archive products are unique or available in quantities of only one.

Adding an item to a shopping cart does not reserve that item.

An item is not considered sold until payment has successfully been processed and the order has been accepted.

Because products may occasionally be offered across multiple sales channels, an item may rarely sell through another channel before inventory systems have fully updated.

If this occurs, we may cancel the unavailable item and issue a full refund for that item.

8. ORDERS

We reserve the right to accept, reject, limit, or cancel any order.

An order confirmation does not necessarily constitute final acceptance of an order.

We may cancel an order for reasons including:

Inventory errors
Pricing errors
Suspected fraud
Payment problems
Incorrect product information
Shipping restrictions
Duplicate orders
Products becoming unavailable
Violation of these Terms

If we cancel a paid order, the appropriate amount will be refunded to the original payment method.

9. PRICING

All prices are displayed in the currency indicated on our website or applicable sales channel.

Prices may change at any time without notice.

We reserve the right to correct pricing or listing errors. If an obvious pricing error affects an order, we may cancel the order and refund the payment.

Promotional pricing, discount codes, and special offers may be subject to separate conditions and may be changed or withdrawn at any time unless prohibited by law.

10. PAYMENT

Customers agree to provide current, complete, and accurate payment and billing information.

Payment may be processed by third-party providers such as Shopify Payments, PayPal, credit card processors, digital wallets, or other payment services.

Patina Archive does not control the separate terms or privacy practices of these payment providers.

Orders may be withheld or canceled if payment cannot be verified or if fraudulent activity is suspected.

11. SALES TAX, DUTIES, AND IMPORT FEES

Applicable sales taxes may be collected during checkout where required.

International orders may be subject to customs duties, import taxes, brokerage charges, VAT, or other government fees imposed by the destination country.

Unless specifically stated otherwise at checkout, these charges are the responsibility of the customer.

Patina Archive is not responsible for delays caused by customs authorities.

12. SHIPPING

Shipping times shown on our website are estimates and are not guaranteed delivery dates.

Once an order is transferred to a shipping carrier, delivery may be affected by circumstances outside our control, including weather, customs processing, carrier delays, incorrect addresses, holidays, or other transportation disruptions.

Customers are responsible for providing a complete and accurate shipping address.

Patina Archive is not responsible for delays or losses caused by an incorrect or incomplete address supplied by the customer.

Additional shipping fees may apply if a package is returned to us because of an incorrect address, refusal, failure to collect the package, or unsuccessful delivery.

13. LOST, STOLEN, OR DAMAGED PACKAGES

Customers should contact Patina Archive promptly if a shipment appears lost or arrives damaged.

Where appropriate, we may assist with submitting a claim to the shipping carrier.

Patina Archive may require photographs, packaging materials, shipping labels, or other documentation before processing a shipping-related claim.

Responsibility for lost, stolen, or damaged packages will be determined according to applicable law, carrier policies, and any shipping protection purchased with the order.

14. RETURNS AND REFUNDS

Returns, exchanges, and refunds are governed by the Patina Archive Return & Refund Policy, which forms part of these Terms.

Customers are responsible for reviewing the applicable return policy before purchasing.

Items must meet all return requirements stated in that policy to qualify for a return or refund.

Where permitted by law, certain items may be designated Final Sale and will not qualify for return.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be waived.

15. ORDER CANCELLATIONS

Because many of our products are unique, orders may begin processing shortly after payment.

Cancellation requests are therefore not guaranteed.

If an order has already been processed, packed, or shipped, it may need to be handled according to our Return & Refund Policy.

16. WHOLESALE ORDERS

Wholesale, bulk, reseller, or business-to-business transactions may be subject to additional terms communicated before the transaction is completed.

Unless otherwise agreed in writing, wholesale sales may have different return, deposit, payment, shipping, and final-sale conditions from standard retail purchases.

Where separate written wholesale terms conflict with these Terms, the separately agreed wholesale terms will control with respect to that transaction.

By using our services, you acknowledge that information may be processed by service providers necessary to operate our business, including ecommerce platforms, payment processors, shipping providers, analytics providers, and communication services.

If you voluntarily sign up for email, SMS, WhatsApp, or other marketing communications, you may receive promotional messages from Patina Archive.

You may unsubscribe or opt out using the method provided in the applicable communication.

Consent to marketing communications is not a condition of purchasing from Patina Archive unless otherwise permitted by applicable law.

19. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Patina Archive name, branding, website design, original photography, graphics, written content, product descriptions, logos, and other original content belong to Patina Archive or are used with permission.

Third-party trademarks displayed on our website remain the property of their respective owners.

23. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, Patina Archive provides its website, services, and products on an “as available” and, where applicable to vintage merchandise, “as is” basis.

We do not make warranties beyond those that cannot legally be excluded.

Because we specialize in vintage and pre-owned goods, customers acknowledge that reasonable signs of previous ownership, age, wear, fading, and use are inherent characteristics of the products we sell.

24. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Patina Archive and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website, services, or products.

Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded.

25. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Patina Archive and its owners, employees, contractors, and affiliates from claims, damages, losses, liabilities, or expenses arising from your unlawful misuse of our website or services or your violation of these Terms.

26. CHARGEBACKS AND PAYMENT DISPUTES

If you believe there is a problem with an order, we encourage you to contact Patina Archive before initiating a payment dispute so that we have an opportunity to resolve the issue.

Fraudulent chargebacks, including falsely claiming that an authorized transaction was unauthorized or falsely claiming that merchandise was not received, may be contested using order records, tracking information, correspondence, photographs, or other available evidence.

Nothing in this section prevents a customer from exercising legitimate rights available through their financial institution or applicable law.

27. GOVERNING LAW

These Terms will be governed by the laws applicable to the jurisdiction in which Patina Archive is legally established, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

Customers may also have rights under the laws of their place of residence that cannot legally be waived by these Terms.

28. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in effect.

29. NO WAIVER

Failure by Patina Archive to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

The current version will be posted on our website with an updated “Last Updated” date.

Your continued use of our services after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.

31. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and Patina Archive regarding use of our website and services.
